Terms of Service

1.1 Object

Calensi provides a digital platform allowing Hosts (owners or managers of short-term rental properties) to:

• synchronize their booking calendars,
• select and engage cleaning or maintenance Agents via an integrated marketplace,
• manage missions, payments, notifications and communications.

These Terms of Use (ToS) apply to any person who registers as a Host on the platform.

1.1b Nature of the service and limitations

Calensi is a software publisher acting as a technical intermediary. The platform does not provide property management services, does not hold any management mandate, and in no case substitutes for a concierge service or agent.

• Calensi does not intervene in the property management of assets (pricing, guest reception, customer relations, etc.).
• Calensi does not exercise any management mandate on behalf of the Host.
• The Host retains full ownership and control of their accounts on booking platforms (Airbnb, Booking.com, VRBO, etc.). Calensi does not create accounts on behalf of hosts and does not require any transfer of ownership or administrator access.
• Upon termination, the Host retains all of their accounts, listings, reviews and history on booking platforms.

1.2 Definitions

« Host » :

the natural or legal person who operates a property rented for short-term rental and uses the Calensi platform to manage services.

« Agent » :

the natural or legal person providing services (cleaning, maintenance, etc.) selected via the platform.

« Platform » :

the digital service provided by Calensi.

« Mission » :

the cleaning or maintenance service entrusted via the platform.

« Party » :

Calensi or the Host depending on the context.

1.3 Access conditions and registration

• The Host must be of legal age and have legal capacity.
• Registration requires creating an account, accepting the ToS and providing required legal information.
• The Host guarantees that the property operated complies with applicable laws (urban planning, short-term rental, etc.).

1.4 Platform operation

• The Host can synchronize their calendars (e.g. Airbnb, Booking.com) and configure their Agent assignment rules.
• The Host may select an Agent via the marketplace or invite and link directly Agents they already know.
• Missions with Agents sourced through the marketplace may be subject to a Calensi commission (introduction fees), as shown in the app.
• For Agents invited or linked directly by the Host without marketplace introduction, no Calensi commission of this kind applies to that relationship, as shown in the app.

1.5 Payment & billing

• The Host pays Agent services via the platform or according to agreed terms.
• Calensi may collect a commission on missions with Agents sourced through the marketplace (introduction fees), as shown in the app; no commission of this kind on Agents invited or linked directly by the Host, as shown in the app.
• The Host remains responsible to the Agent for Mission payment.

1.6 Service access

Host features are offered free of charge, under the conditions displayed in the application and on the website. The number of properties and the scope of available features are those shown in the interface. The economic model and access conditions may evolve (including toward subscription plans or usage caps for certain cases, such as managing multiple properties); the applicable terms will then be those of the ToS and interface published at the relevant time.

Calensi may update these ToS and commercial terms, in particular when introducing subscription plans, usage caps, or changes to the economic model. Users will be informed by appropriate means. Continued use of the service constitutes acceptance of the ToS in force, subject to mandatory rules.

1.7 Host liability

The Host is solely responsible for:

• compliance of the rented property with legal obligations (safety, short-term rental legislation) ;
• providing accurate information at registration and for each Mission ;
• payment of retained Agents or managing any disputes with them.

The Host must take out necessary insurance (civil liability, property damage).

1.8 Calensi liability – Limitation

Calensi acts solely as a technical intermediary between Host and Agent. Calensi does not directly intervene in Mission execution.

Consequently, Calensi cannot be held responsible for:

• damage caused by the Agent to the Host or property ;
• the Agent's failure to fulfill cleaning/maintenance obligations ;
• conflicts between Host and Agent.

Calensi's liability is limited to the amount paid by the Host to Calensi for the relevant Mission.

1.9 Account termination / suspension

• Calensi may suspend or terminate the Host account in case of serious breach of these ToS, fraud or public authority request.
• The Host may close their account after settling all outstanding obligations.

1.10 Applicable law – jurisdiction

• These ToS are governed by French law.
• Any dispute will be submitted to the competent courts of Calensi's registered office (France).

1.11 Personal data

• Calensi processes personal data according to its privacy policy compliant with the General Data Protection Regulation (GDPR) and French legislation.
• The Host consents to the use of their data for Service operation (notification, billing, Agent assignment).
• Profile photos and property photos are considered personal data. They are stored securely and used only within the framework of platform operation (identification, property management, communication with Agents).
• The Host may delete their photos from their account at any time. In case of account closure, all associated photos are deleted in accordance with GDPR obligations.

1.12 Uploaded content

• The Host guarantees being the holder of rights on photos they upload on the platform (profile photo and property photos) or having obtained necessary authorizations.
• The Host undertakes not to upload illicit, defamatory, violent, pornographic content or content infringing third-party rights (image rights, copyright, etc.).
• In case of a third-party claim regarding an uploaded photo, Calensi reserves the right to immediately delete the disputed content without notice, and the Host assumes full responsibility.
• Calensi may use property photos for communication and platform promotion purposes, respecting personal information confidentiality.

1.13 Insurance and compliance

• The Host guarantees having necessary insurance coverage and respecting legal obligations (e.g. declaration, rental authorization, tourist tax).
• If necessary, the Host will provide Calensi or the Agent with required documentation.

1.14 ToS modification

• Calensi may modify the ToS at any time by informing the Host.
• Continued use of the service after modification constitutes acceptance.
